User Agreement

This document "User Agreement" (hereinafter referred to as the "Agreement") is a public offer to use the site https://wosk1147.com (hereinafter referred to as the "Site"), operated by the Limited liability company : “WOSK 1147” DOO TIVAT.

The use of the Site means the User's unconditional, informed, voluntary consent to this Agreement and the conditions for processing his personal information specified therein; in case of disagreement with these conditions, the User must refrain from using the Site.

Users of the website can only be persons of legal age or legal entities. Purchases on behalf of minors can only be made by their legal representatives and/or guardians.

In this Agreement, unless the context requires otherwise, the following terms have the following meanings:

Site - website https://wosk1147.com and the Wosk1147 mobile application, which are a service that provides access to information about goods intended for potential buyers.

The User is any individual who uses the Site, both in his own interests and in the interests of any third parties.

A seller is an individual entrepreneur, legal entity or self-employed citizen who sells goods and offers the User, including through an Agent, to conclude a contract for the sale of the Goods by placing the Goods on the Site. 

The Good is the subject of a purchase and sale agreement concluded between the User and the Seller or his Agent.

Order is the implementation by the User of actions aimed at concluding contracts for the purchase and sale of goods, the provision of delivery services using the functionality of the Site.

The User unconditionally confirms that he is voluntarily a user of the Site under the following conditions:

Terms of the Site use

1. Any person, from the moment of his first visit and during the time of using the Site, including its personalized services, to a personal appeal to the Site administration with a request to cease any relationship with the Site, is its User.

2. Use of the Site by the User in any way, in any form, within the limits of its functionality, including:

4. The Site is a trading platform (marketplace) providing access to information about products intended for potential buyers.

5. The Site provides the Buyer with:

a free opportunity to get acquainted with offers for the sale of goods posted on the Site, the possibility of concluding a contract for the sale of goods using the functionality of the Site, the possibility of receiving offers and information.

access to the personalized services of the Site, i.e. a personal and not accessible to third parties section of the Site created for the purpose of placing Orders, as well as receiving special offers in accordance with these Rules, access to which is carried out.

to create ratings and opinions, participate in special programs and other promotions conducted by the Site

6. Consent to receive advertising and informational messages: by subscribing to SMS and emails from https://wosk1147.com or third parties authorized to send it on behalf of https://wosk1147.com , on the Internet, the User agrees to receive such messages to the phone number and email address specified by him. The user is informed that in order to unsubscribe, it will be necessary to independently click on the link "Unsubscribe from the subscription" indicated in the text of the messages sent by the site or to inform about the disagreement of receiving such messages to the addresses specified in the "Contacts" section of this Agreement.

7. The user agrees that the Site is not responsible for delays, failures, incorrect or untimely delivery, deletion or failure to save any notifications.

8. The User agrees that the description accompanying the product on the Site does not claim to be exhaustive and may contain inaccuracies.

Due to the general nature of doing business on the Internet, the assortment offered on the website https://wosk1147.com/ is constantly updated and changed. WOSK1147 DOO strives to provide clear and basic information to present the basic characteristics of the items it receives from suppliers, which is why WOSK1147 DOO is not responsible for possible errors such as irregularities, incompleteness, etc. in the data for possible damage that may result from it.

9. The User agrees that the price and availability of the goods on the Site changes around the clock without prior notice and are indicated in the individual status and detailed product card displayed in the catalog on the Site.

Pricing & currency

Web Shop Price (“WSP”) of goods is indicated with each item. All prices are expressed in currency – euro („€“).

The prices listed on the Web Shop are valid only for purchases on the Web Shop and may differ from boutique retail prices.

The item ordered through the Web Shop is paid for at the price shown on the Web Shop at the time of purchase.

All payments will be effected in – euro („€“) – Montenegro national currency. The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.

10. The User undertakes not to use the services of the Site in order to:

uploading content that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and/or discrimination on racial, national, sexual, religious, social grounds; contains false information and/or insults against specific individuals, organizations, authorities;

inducements to commit illegal actions, as well as assistance to persons whose actions are aimed at violating restrictions and prohibitions in force on the territory of the Montenegro and EU coutries;

violations of the rights of minors and/or causing them harm in any form;

infringement of the rights of minorities;

impersonating another person or a representative of an organization and/or community without sufficient rights, including employees of the Site;

misleading about the properties and characteristics of any goods from the catalog on the Site; incorrect comparison of goods, as well as the formation of a negative attitude towards persons who (do not) use certain goods, or condemnation of such persons;

uploading content that you do not have the right to make public under the legislation of the Montenegro or under any contractual relationship;

uploading content that relates to and/or contains any patent, trademark, trade secret, brand name, copyright and related rights, as well as other rights to the results of intellectual activity owned or lawfully used by third parties;

uploading advertising information and/or spam that is specifically not permitted;

collection and processing of personal data, information about the private life of any person;

violations of the normal operation of the Site;

violations of one of these conditions as terms of the accession agreement, in accordance with the provisions of the Montenegro or international law.

The User understands and agrees that the Site has the right (but not the obligation) at its sole discretion, refuse to post and/or delete any content available through the services of the Site, as well as to report these facts to law enforcement agencies. The User agrees not to use abusive words, obscene and offensive images, comparisons and expressions on the Site, including in relation to gender, race, nationality, profession, social category, age, language of a person and citizen, as well as in relation to organizations, authorities, official state symbols (flags, coats of arms, anthems), religious symbols, cultural heritage objects (historical and cultural monuments).

Responsibility

13. Services of the Site may contain links to other resources. The User agrees that the Site is not responsible for the availability of these resources, for their content, as well as for any consequences associated with your use of the services and content of these resources.

14. Responsibility for the actions of minors, including their purchase of goods from the catalog on the Website, lies with the legal representatives of minors.

15. The User agrees that in case of non-fulfillment and / or improper fulfillment by the Site of its obligations to sell and / or deliver goods to the User due to the provision of false and / or invalid data about themselves, as well as their failure to comply with the terms of this Agreement, the Site does not bear any responsibility.

Return and unilateral termination of the contract

The customer, who ordered the product via the website https://wosk1147.com/ has the right, without giving any reason, to unilaterally terminate the contract within 14 (fourteen) days from the day of delivery of the product to the customer or to a third party designated by the customer, and which is not a carrier.

In case of unilateral termination of the contract concluded at a distance, the Customer is obliged to bear the costs of returning the goods.

The Customer is obliged to return the goods without delay, and no later than within 14 (fourteen) days from the date of notifying the Merchant of the decision to terminate the contract.

"WOSK1147" DOO as Merchant and owner of the website https://wosk1147.com/, in terms of the Code of Conduct in the sale of goods and provision of services on the Internet market of Montenegro (“Official Gazette of Montenegro”, no. 31/2016), during business on the Internet market acts in an appropriate and correct manner with respect for the Consumer and courtesy, accepting and providing additional information to the Consumer, regulating the Consumer’s request, seeking a solution in accordance with good business practice and responding to complaints and objections with facts, arguments and, above all, solutions.

The Site informs the User that the deadline for responding to sent proposals, questions and other requests is 30 calendar days, unless other terms are established by law.
